They weren’t sued, even though they all were involved in one genocide or another
Read the headline over and over again until you get what I mean.
Correct way to say it is “Biden is first sitting US presedent to be sued for genocide”
I think their correction is a grammatical one: they’re saying “Biden makes history:” is separate, so the “1st sitting US president” part implies that the article is about the first US president ever.

Ignoring the first three words, It’s just a noun clause, which describes Biden. So the whole headline is just a run on sentence. Your brain tries to interpret it as a full sentence (as you should) but it’s incorrect.
